Apparently, there's a reason why Gabriel Aubry recently panicked over his paternity.

The Canadian model filed a motion on December 30 to be officially, legally declared the father of Nahla, the two-year old daughter he shares with Halle Berry. Insiders tell Radar Online his concern over custody status is based on a series of explosive fights with his ex.

"Whenever Gabriel doesn't do exactly what Halle Berry tells him to do, or if he does something she doesn't approve of or like, she goes crazy on him, screaming and shouting," the source says.

Referring to Berry as someone with a "nasty temper," this friend says things grew more heated than ever near the end of the year, as Aubry was spotted out in public with Kim Kardashian and others.

"Halle was absolutely furious and had a complete melt-down. She basically gave him an ultimatum: choose between dating other women and carrying on being on her good side... in the end he just got sick of being bossed around and told what to do by his ex-girlfriend."

For that reason, Aubry can't trust that he and Berry can peacefully work out a custody arrangement outside a courtroom.

The source makes it clear that Gabriel believes Halle Berry is a good mother, and has no intention of fighting for full custody of Nahla. He just wants to ensure his rights as her father are protected, especially as Berry has allegedly gone to extreme lengths to discredit him.

"Gabriel Aubry told me that he believes Halle Berry is having him tailed by a private investigator, and he's not just some paranoid dude with a wild imagination... if she thinks a PI is going to dig up anything salacious or scandalous I think she'll be sorely disappointed. Gabriel's one of the straightest, nicest, bordering on boring guys I know."

Halle Berry’s ex Gabriel Aubry has filed legal documents to declare him the father of 2-year-old Nahla. Aubry filed a petition for joint physical and legal custody and support back on December 30. Based on what we know about Gabriel Aubry, he’s a real prince of a guy.

When the couple split and he left his girlfriend and his baby daughter, a friend of Aubry told RadarOnline.com:

“Gabriel just felt it wasn’t working anymore…when they were first together, the 9-year age difference between them didn’t phase him…but as time went on he started feeling it more and more. Also, Gabriel started noticing other women and being attracted to others, and he felt it just wasn’t right to stay with Halle in those circumstances.”

Excuse me while I gag.

Sounds like Halle Berry needs to lawyer up for a custody battle and things are going to get ugly between Halle Berry and Gabriel Aubry. But let’s hope that it doesn’t get too bad for baby Nahla’s sake.

Until December 30, the former couple had left the courts out of their custody agreement but baby daddy Aubry wants to change that.

Adding more fuel to the relationship rumor fire, Kim Kardashian was spotted out with Gabriel Aubry in Sherman Oaks, California last night (November 25).

The “Keeping Up with the Kardashians” babe and the male model took in a showing of “Burlesque” at the Arclight Cinema before hopping into Gabriel’s white Rolls Royce and heading off into the night.

Earlier this month, Kim and Gabriel were seen together at a Los Angeles Lakers game, though her mom Kris Jenner insisted they’re just friends.

However, with last night’s un-chaperoned date, it looks like Kim and Gabriel may be taking things beyond the friend realm.

Kim Kardashian's found a new guy to keep up with: Halle Berry's model ex Gabriel Aubry. A pal tells Us Magazine that the duo, who were spotted flirting at Sunday's L.A. Lakers game, are the real deal.

"They met through friends and have been dating a few weeks," says the source. "It's sexy!" Adds the insider, "They decided to step out together at the game."

The hot Gucci model, 34, is not the first guy the reality star, 30, has been linked to since splitting with Reggie Bush in March. After a summertime romance with football hunk Miles Austin, Kardashian has been dating casually -- including a few recent nights out in NYC with singer John Mayer.

Aubry, meanwhile, has been laying low since he and Berry, 43, ended their four-year relationship in late April, although he and the Oscar winner spent some time in Paris with daughter Nahla, 2, in August. Berry has since gotten cozy with her Dark Tides costar Olivier Martinez.

The budding romance has already gotten a thumbs up from Kardashian's pal Jonathan Cheban. "I can't wait to hear all about it," the SPINdustry star told Us at a Lorraine Schwartz event Monday night. "I hope they're together so I don't have to go to football games anymore!"
